Naming songs or artists in a novel

In one of my scenes, a character is listening to the radio, and although I have the song she is listening to in my head, I am not sure if it's ok to name the song or artist without repercussions from doing so when I do attempt to publish.

 Does anyone have experience with this? I have been researching, and can't find anything. I could use some help. Thanks.

Generally not a problem if you are saying nice things. If you trash a song or artist, in most cases you would not be liable, but if your work make it to the public domain, you could receive a lot of flack.

Thanks for the input. I really appreciate the help. I think I'm going to lean toward a generic sound rather than song. Avoid the trouble.

Yep, you can name the song and the artist. Just don't quote lines from the song.

... Um, in that case I may have a problem. I know I'm not the first to do this, though - kinda got the idea from Ann Brashares - so does anyone know the procedure if you do want to use song lyrics in your story? See, I title each chapter using a song (with credit given in the chapter list at the beginning) and then at the beggining of each chapter I've got a line or two from said song, to kind of introduce / sum up the mood of the chapter.

 

 For example, my table of contents looks like this:

Ch. 1: "Hello" (Evanescence) (page 9)

Ch. 2: "Dare You to Move" (Switchfoot) (page 16)

 

Then, when you go to page 9 you'll find this:

chapter one

"If I smile and don't believe... soon I know I'll wake from this dream...."

 Wednesday afternoon in the midst of what seems a never-ending break and visit home.... etc, etc.

 

It's very important to me that I keep in these songs, if I can, and I know that there are lots of books out there that open each chapter or section or whatever with quotes, song lyrics, etc. So does anyone know how that all works?

I have seen a number of these questions, whether it's legal to use real songs or artists names, to attribute fictitious stories to reputable newspapers, or use actual product or corporate names. The real answer is that we are not lawyers. We are writers. Write. Write it the way you want it. Once a publisher buys your work, you will go into edits. The publisher's legal department will then have a say and they may ask you to make changes for legal reasons. For now, don't worry about it. Write the strongest book you can.
