real names of the deceased

I'm currently writing a fiction book based on fact.  The time period is the late 1800's.  Do I need permission from living relatives to use these names?  Some of the names I have just gotten off the 1880 census for people living nearby.  Would it be sufficient to have a disclaimer, or possibly an epilogue saying it is a fictionalized account based on a real person?

I think a disclaimer will work fine - it's fiction. All the names you intend to use are long dead. Little to no evidence exists about what these people did in their day to day. Not only that, but any name you pick for fiction is likely to be someone elses living or dead.

Sounds good to me.  I guess no matter how crazy a name you think up, someone somewhere will have one very similar.  I've only made up one name in this story, and it's only a first name.

 Long dead, no information.  No way to prove or disprove.  I like your answer.
